Saying "he" in a situation where gender is not known or important is correct... A large, possibly unrelated, example would be calling the entire human population "man". (Though I don't know why that is singular... Collective noun, maybe?)
"Man" for the human race is collective, just like "the human race" or "mankind".
And yes, "he" is the correct pronoun when referring to an object of unknown gender. If you want to talk gender sex bias though, look at German where the word for "girl" is of neutral gender, and thus uses the German equivalent of "it".Nah, the German word for girl is Mädchen, which pretty much means little lady (chen is little) and any word with chen added onto is automatically neutral gender. It's not a bias it's just the language mechanics.

As for human rights, they're really ideals. Yes, most people like the idea. However, most people are also hypocrites (myself not excluded) and only use the human rights things when it suits them. Eventually, the ideal can become reality, but I don't see that happening any time soon.
